Silicon Knights was kind enough to send along both their formal press release concerning their suit against Epic and the actual suit itself. According to the suit, which seems more than $75,000, Epic Games misrepresented the abilities of their Unreal Engine 3 when selling the license agreement to Silicon Knights. The suit says that Epic failed to "provide a working game engine" to Silicon causing them to "experience considerable losses."
The developer was rumored to be experiencing problems with the Unreal Engine platform last summer, but later denied speculation it was dropping the platform and commented that the game was still "progressing very well." Silicon Knights eventually decided to drop the Unreal engine and instead build their own, according to the suit.
Silicon also claims that Epic has been "sabotaging" Silicon Knights efforts to make a game by using the money earned from their licensing deals to make their own games rather than to provide support for their engine to Silicon and other licensees.
Update: In a nutshell, SK claims that Epic used a slicker version of their Unreal Engine for Gears of War and released a hamstringed version to SK and others, in order to show them up at E3. They also failed to release the Gears version until much more recently, SK claims. They also claim that Epic made several very specific statements about what the engine could do, but which it was never able to deliver on including the number of on-screen characters and lighting effects.
The suit is based on a dozen causes of action including fraud, negligent misrepresentation, intentional interference with contractual relations, intentional interference with prospective economic advantage, breach of warranty and a violation of North Carolina's unfair and deceptive trade practices act.
The suit also says that Epic missed the deadlines for providing both the 360 and PS3 engines. Finally, the suit alleges, the SK gave up on the engine and built their own, which is what Too Human use.

According to some posts over there, nearly every UE3 based game was delayed.

That is not what the lawsuit says. The lawsuit says that a version of Unreal was not delivered to SK by the date agreed upon in the license, even though a version that worked very well (see Gears E3 06) actually existed. They claim the reason Epic did not deliver something they owed and were capable of delivering was that they wanted their game to look the coolest.
Also, if you aren't too ignorant to read, you will see that SK claims to have dropped Unreal quite some time ago (I bet right around when they denied a rumor of doing so) and has been building the game on their own engine. Anything we've seen lately is on "their" engine.
The truly juicy part, which most of you tards are too ignorant to catch so I have to spell it out for you, is that they claim their SK engine is so different from Epic's that it is now their own property. But the very fact that they mention how it is different than Epic's implies that it is also similar, and probably started out as Epic's. Otherwise, they'd say they just built a game ground up.
So, let's assume this is all true. Epic was focused so hard on Gears that they said screw it to SK and giving them the working engine within the time alloted. At some point, SK said we're sick of sitting around with our thumbs in our asses, we are building an engine on top of this basic version that Epic licensed to us and that we have already done quite some work with. We made it different enough that we claim our version is now our engine, which can be sold perhaps. In addition, we want money for Epic not delivering on their promise and basically costing us a shitload of money.
If SK pulls this off, it would be a killer triple burn. They could get money they paid plus damages, plus avoid the royalty fee you must pay if you actually sell the game you licensed the engine to build, plus they end up with an engine of their own that they perhaps couldn't have made without the base that Epic gave them.
This could have nothing to do with reimbursement or the shitty service Epic gave them. It could be a way for them to try to fandangle their own engine by sorta copying Epic a bit.
This is mad juicy. I bet they confronted Epic a while ago like "we want our money back or we'll sue, we ain't using your shit anymore" to which Epic replied "**** off"
As far as the future of Too Human, they have shown it running since they allegedly dropped Unreal, so my guess is that it works just fine on the SK engine and is coming along. But, if Epic could prove the SK engine is too similar to Epic's, they could screw them back.
I am very interested in how this turns out.
 
Ainda não tinha lido essa teoria da conspiração que diz que isto é uma "jogada" da SK... até faz sentido mas a ser verdade duvido que se safem se estiverem a usar código da Epic.

Se de facto for verdade que a Epic caga para quem licencia o engine então estão a cometer um grande erro...
 
mas afinal aqueles jogos que vão usar o UE3 foram ou não adiados????

as empresas estão a ter ou não dificuldades em fazer as coisasd ?? ou foi só a S.K. ?
 
eu acho que estão todos delayed e realmente estão a demorar muito tempo a aparecer, mas o rainbow six, já apareceu sem problemas.
