Microsoft sued by family of baby killed in fire due to overheated Xbox 360 wiring

A family in Illinois is now suing Microsoft for their house that burned down because of a faulty Xbox 360 wiring, causing the death of their infant, Wade Kline. Allegedly, the wire connection to the console overheated and started the fire.

The suit claims, "The fire was a direct and proximate result of the overheating of the game console's power supply and wiring." Joining Microsoft as defendants are Wal-Mart, the store where the wire was bought from, and an unnamed power-supply maker. The family of baby Wade is seeking unspecified damages not to go below US$ 50,000.

The facts of the case reveal that the fire occurred on December of 2004, however, the Xbox 360 did not launch until May of 2005. As such, it follows then that it must have been the first-generation Xbox, and not the Xbox 360 unit, as the family has said. Speaking in behalf of Microsoft, a spokesperson addressed the issue:

Microsoft recently learned about this tragic incident that occurred in 2004. Our sympathy is with the family. However, we are not aware of any evidence that an Xbox caused the fire. Also, the complaint specifically states that an Xbox 360 was involved, but this version of the product was unavailable for purchase at that time.

If you will recall, Microsoft recalled more than 14 million Xbox power cords back in February of 2005 for supposedly being a fire hazard.
